1. Agreement to Terms
By accessing and using Postbing, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.
2. Description of Service
Postbing provides keyword rank tracking and AI visibility analysis tools. We provide data obtained from third-party search engines and models.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Acceptable Use
You agree not to use Postbing for any illegal or unauthorized purpose. You shall not attempt to hack, disrupt, or interfere with our services.
5. Subscription and Payments
Postbing offers paid subscription plans. All payments are processed via Stripe. Subscriptions automatically renew unless cancelled.
6. Limitation of Liability
Postbing shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our services.
7. Termination
You may cancel your subscription at any time from your billing dashboard. We may suspend or terminate your account without notice if you breach these Terms, engage in abuse, or fail to pay amounts due. On termination, your access ceases and we delete your data per the retention schedule in our Privacy Policy.
8. Intellectual Property
Postbing, its logo, and all original content, features, and functionality are the exclusive property of Postbing and its licensors. You retain ownership of the data and content you submit to the platform, and you grant us a non-exclusive, worldwide license to host, process, and display that content solely to operate the service for you. We do not use customer data to train AI models.
9. Indemnification
You agree to indemnify, defend, and hold harmless Postbing, its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the service, your violation of these Terms, or your violation of any third-party right.
10. Disclaimers & Liability Cap
The service is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, Postbing's aggregate liability for any claim arising out of or relating to these Terms or the service is limited to the amounts you paid us in the twelve (12) months preceding the event giving rise to the claim, or USD $100, whichever is greater.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
12. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of material changes by email and by posting the updated date at the top of this page. Continued use of the service after changes take effect constitutes acceptance of the new terms.
